Tampering with Identification Numbers

Chapter 31 of the Texas Penal Code defines theft related offenses.

“Tampering with Identification Numbers”, as per § 31.11 of the Texas Penal Code, occurs when a person knowingly or intentionally removes, alters, or obliterates the serial number or other permanent identification marking on tangible personal property, or possesses, sells, or offers for sale tangible personal property and:

  • the actor knows that the serial number or other permanent identification marking has been removed, altered, or obliterated; or
  • a reasonable person in the position of the actor would have known that the serial number or other permanent identification marking has been removed, altered, or obliterated.

An offense under this section is a Class A misdemeanor.

Punishment Range

Misdemeanor A

  • Confinement in jail for a term not to exceed one year
  • Fine not to exceed $4,000
  • Both such fine and confinement
