Robbery

Chapter 29 of the Texas Penal Code defines robbery and aggravated robbery charges.

“Robbery”, as per § 29.02 of the Texas Penal Code, occurs when a person, in the course of committing theft as defined in Chapter 31 and with intent to obtain or maintain control of the property, they:

  • intentionally, knowingly, or recklessly causes bodily injury to another; or
  • intentionally or knowingly threatens or places another in fear of imminent bodily injury or death.

An offense under this section is a felony of the second degree.

Punishment Range

Second Degree Felony

  • Imprisonment in the institutional division for not more than 20 years or less than two years
  • In addition to imprisonment, may receive a fine not to exceed $10,000
