Criminal Nonsupport

Chapter 25 of the Texas Penal Code places restrictions and guidelines on offenses dealing with the family.

“Criminal Nonsupport”, as per § 25.05 of the Texas Penal Code, occurs when an individual intentionally or knowingly fails to provide support for the individual's child younger than 18 years of age, or for the individual's child who is the subject of a court order requiring the individual to support the child.

An offense under this section is a state jail felony.

Punishment Range

State Jail Felony

  • Confinement in a state jail for not more than two years and not less than 180 days
  • In addition to confinement, may receive a fine not to exceed $10,000
