Denton, Lewisville, Flower Mound and Corinth DWI and Criminal Attorney |
|
Misdemeanor offenses are commonly referred to as "minor" offenses.
Despite this generally-accepted thought, the maximum penalties for
a misdemeanor in Texas are hardly minor and can be devastating to a
career. The Texas Legislature has divided misdemeanors into three categories:
| Class of
Misdemeanor |
Maximum Punishment |
Examples
of Some Misdemeanors Under
This Class |
C |
 |
In
most cases a fine up to either $200 to $500 plus costs of court.
Only in rare instances would incarceration accompany a Class C
Misdemeanor |
 |
Speeding
or Parking tickets, many traffic violations, Public Intoxication,
Failure to Provide Proof of Financial Responsibility (no auto insurance-1st
offense) |
B |
 |
Usually
up to 180 days in the County Jail and up to a $2,000 fine (some
class B misdemeanors have lesser maximum punishments; e.g. Reckless
driving) |
 |
DWI
(1st offense), Driving While License Suspended, Evading Arrest,
Possession of Marijuana (less than 2 oz.) |
A |
 |
Usually
up to 365 days in the County Jail and up to a $4,000 fine |
 |
DWI
(with one prior conviction)
Resisting Arrest, Assault
Causing Bodily Injury (many family violence cases): Burglary of
a Motor Vehicle; Possession of Marijuana (more than 2 but less
than 4 ounces)
