If someone is arrested, in order to secure release from jail the Defendant has to post a bond. The bond is intended to be a guarantee that the Defendant will appear in Court as required. Bonds differ in amounts and normally increase in amount with the seriousness of the offense. Bond types include:

The Defendant places the entire bond amount (for example $1000.00 for a $1000.00 bond) on deposit with Denton County. If the Defendant appears in Court as required and the Bond is not forfeited, then the entire amount is refunded to the Defendant after disposition of the case. Normally court costs or fines, if any, are deducted by the County prior to refund of the Cash Bond.

The Defendant contracts with a Bail Bondsman licensed to do business in Denton County and pays a portion of the bond amount as a non-refundable service fee in exchange for the Bondsman issuing a surety bond which guarantees the Defendant's appearance in Court. Typically a $1000.00 bond would require a service fee of approximately $165.00 to $210.00 depending on circumstances. Higher bonds normally require a 10 % service fee (10% of the bond amount). Bail Bond Companies may require a co-signer for bonds of higher amounts.

The P.R. Bond allows a criminal defendant to sign a bond without the necessity of paying any money down (either in the form of a cash bond or a surety payment). If the Defendant does not appear in Court, then the County would attempt to collect the amount of the bond through a Court proceeding. P. R. Bonds are rarely granted by the Magistrates or Judges in Denton County (except in Theft by Check cases -- if and only if the Defendant surrenders to the Denton County Sheriff's Office).
