  • Not having the normal use of mental facilities by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more substances, or any other substance into your body.

When stopped, it is important that you know and understand your rights. There are certain indications that officers look for when searching for drunk drivers. Some of the symptoms include:

  • Turing with a wide radius
  • Weaving
  • Swerving
  • Speed more than 10 mph below the speed limit
  • Driving into opposing lanes or crossing traffic
  • And headlights off

If stopped by a police officer, you are not required to answer any potentially incriminating questions. Do not admit guilt or apologize for anything. Just be polite and let the officer know you would like to speak to an attorney before answering any questions. If you are asked to take any Field Sobriety Tests, you can politely decline. You do have the right to refuse them.

It is also important that you are aware of the punishments that may occur. A first DWI conviction is a Class B Misdemeanor with a jail sentence to confinement in the County Jail from 72 hrs. to 180 days, with a fine not to exceed $2,000. A second DWI conviction is a Class A Misdemeanor with a jail sentence to confinement in the County Jail from 30 days to a year, with a fine not to exceed $4,000. A third DWI is a Third Degree Felony with penitentiary confinement in the Texas Department of Criminal Justice/ Institutional Division for 2-10 years, and a fine not to exceed $10,000.
