A first DWI conviction is a Class B Misdemeanor with a jail sentence to confinement in the County Jail from 72 hrs. to 180 days, with a fine not to exceed $2,000. A second DWI conviction is a Class A Misdemeanor with a jail sentence to confinement in the County Jail from 30 days to a year, with a fine not to exceed $4,000. A third DWI is a Third Degree Felony with penitentiary confinement in the Texas Department of Criminal Justice/ Institutional Division for 2-10 years, and a fine not to exceed $10,000.
